Terms and Conditions for FlushPlates.com
The terms detailed below govern the sale of bespoke finished products provided by R Brookes T/A FlushPlates.com ("FlushPlates.com and or FlushPlates.co.uk " "we," ,our,or "us"). By placing an order or submitting payment, you agree to be bound by these conditions.
1. Provision of New Items
1.1 Mandatory New Supply: We do not offer a refinishing service for used, "pre-owned," or customer-supplied flush plates. Every order includes a brand-new, genuine flush plate sourced directly by us. This policy is absolute to ensure the finish is applied to a pristine substrate, eliminating the risk of surface blemishes, pitting, or tarnishing inherent in used materials.
1.2 Bespoke Nature of Goods: All products are customised to your specific finish request. Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, these items are "made to the consumer’s specifications" and are strictly non-refundable and non-returnable. Once the finishing process has commenced, the contract cannot be cancelled or amended.
2. Finish & Colour Disclaimer
2.1 Standard Finishes: When you order a finish (e.g., "Brushed Brass"), you are purchasing our specific professional version of that finish. The finish provided is the final product.
You understand that the finish process is not a "Colour Matching" service.
It offers a range of colours to complement various manufacturers finishes.2.2 Requests for Tonal Blending: If you specifically request a "tonal blend" to a particular manufacturer’s fixture, we will endeavour to achieve a close proximity using our bespoke process. However:
We do not guarantee an exact match.
Due to variations in base materials and light refraction, an identical match is not possible.
Any "tonal blend" is provided on a best-endeavours basis only.
2.3 Batch & Substrate Variance: You acknowledge that bespoke finishing is subject to minor variations. Differences in tone or texture may occur between production batches or due to the substrate material (e.g., the same finish appearing differently on plastic vs. metal components).
2.4 Rejection of Subjective Claims: A perceived "mismatch" or tonal difference between our product and a third-party fixture is not a manufacturing defect. Such variations are inherent to the bespoke process and do not entitle the buyer to a refund, discount, or replacement.
3. Customer Responsibilities & Compatibility
3.1 System Compatibility: It is the customer’s sole responsibility to ensure the flush plate model ordered is compatible with their specific cistern system (e.g., Geberit, Grohe, Tece). We are not liable for orders placed for incorrect or incompatible models.
3.2 Inspection upon Receipt: Goods must be inspected within 48 hours of delivery. Any claims for transit damage or mechanical faults must be reported within this window.
4. Warranty & Aftercare
4.1 Finish Integrity: We guarantee the adhesion of the bespoke finish (ensuring it does not peel or flake) for a period of 12 months from the date of dispatch.
4.2 Maintenance Requirements: Bespoke finishes are delicate. The warranty is void if the product is cleaned with abrasive sponges, bleach, solvents, or acidic bathroom cleaners. Cleaning must only be carried out with a soft, damp microfibre cloth.
4.3 Exclusions: This warranty does not cover "swirl marks," surface scratches, or tarnishing caused by environmental exposure, hard water deposits, or chemical contact post-delivery.
5. Limitation of Liability
5.1 Total Liability: Our maximum aggregate liability for any order, whether in contract or tort (including negligence), shall be limited to the total price paid for the goods.
5.2 Consequential Loss: We shall not be liable for any indirect or consequential losses, including but not limited to: plumber's fees, installation costs, project delays, or "loss of aesthetic harmony" within a room.
6. Governing Law
6.1 Jurisdiction: These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
7. Nature of Bespoke Goods & Visual Representation
7.1 Illustrative Images: The Customer acknowledges that all images on FlushPlates.com and FlushPlates.co.uk are for illustrative and layout purposes only. Photographs may not represent the specific finish selected. The contract is based strictly on the written description of the finish in the order confirmation.
7.2 Substrate & Base Material Variance: The Customer understands that the final aesthetic of a bespoke finish is dictated by the base material of the hardware (e.g., ABS Plastic vs. Solid Metal) and the original factory foundation (e.g., Gloss Chrome vs. Brushed). Consequently, variations in lustre, depth, and tone are inherent to the process and do not constitute a defect.
7.3 Tonal Blending: Where "Tonal Blending" is requested to complement third-party manufacturers, FlushPlates.com aims for a professional aesthetic harmony. However, due to differing manufacturing processes and light-reflective properties of different materials, an exact 100% match is not guaranteed.
7.4 Batch Variation: As an artisanal, hand-finished product, items produced in different batch runs may exhibit minor tonal shifts. The Customer accepts these variations as part of the unique character of bespoke-finished goods.
FINAL ACCEPTANCE BY PROCEEDING WITH YOUR ORDER, YOU ACKNOWLEDGE THAT YOU ARE PURCHASING A BRAND-NEW PRODUCT WITH A BESPOKE FINISH. YOU EXPRESSLY ACCEPT THE "BEST ENDEAVOURS" POLICY REGARDING TONAL BLENDING AND AGREE THAT ALL SALES ARE FINAL AND NON-REFUNDABLE.
