The terms detailed below govern the bespoke finishing service provided by R Brookes T/A FlushPlates.com ("the Website," "we," "us," or "our") and supersede all prior understandings or agreements. By accepting our quote or commissioning work, you agree to these conditions.

1. The Bespoke Service

1.1 Bespoke Service: The finishing service provided is entirely bespoke, tailored specifically to the item you supply and the finish you request. This process involves specialized techniques applied to your unique item.

1.2 Final Sale & Non-Refundable Policy: Due to the custom nature of this service, all sales are final and strictly non-refundable once the service commences (i.e., once the preparation, stripping, or application process has begun). Cancellation requests must be submitted in writing before work commences, and any costs incurred up to that point may be deducted from any refund issued.

1.3 Bespoke Bath Sales: All sales of bespoke finished baths are strictly non-returnable and non-refundable, except in the case of a demonstrable manufacturing defect that makes the bath unusable. This is due to the customised nature of the service, meaning the provisions of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 relating to distance selling cancellation rights typically do not apply.

2. Client Responsibilities

2.1 Preparation: You are responsible for ensuring all items are properly disassembled (if required) and safely packaged for transit.

2.2 Accuracy of Information: You warrant that all information provided to us regarding the item's material, prior finish, and condition is accurate to the best of your knowledge.

2.3 Risk of Inbound Item: The item remains at your risk until it is physically received and signed for by us. We are not liable for damage or loss incurred during transit to our premises.

3. Assessment & Commencement

3.1 Enquiry and Quotation: All service requests begin with a formal enquiry. Following inspection of your physical item, we will issue a final, non-obligatory quotation.

3.2 Acceptance and Agreement: By formally accepting our quotation and submitting payment, you enter into a binding contract for the bespoke service and you expressly agree to the terms, including the non-refundable nature of the service, as detailed in Section 1.

3.3 Item Inspection and Suitability: Work will only commence after we have inspected your item and confirmed its suitability for our finishing process. We reserve the right to decline or postpone the service if the item is deemed unsuitable and a full refund will be issues and the item posted back to you.

3.4 Commencement of Service: Work will only commence upon receipt of the agreed payment in full. The service is deemed to have commenced when the item enters our workshop for preparation (stripping, sanding, pre-treatment).

4. Disclaimers & Waivers

4.1 No Guarantee of Perfect Match (Blending Pallet): We use high-quality, professional processes to achieve the requested finish. However, due to inherent variances in base metals, prior coatings, material composition, lighting, and the precise application environment, we offer no guarantee that any custom finish will match another product (such as existing brassware or a specific RAL colour) perfectly or exactly. By accepting our quote, you acknowledge and agree that our goal is to blend the item into the same colour or tonal pallet of the existing finish, and minor colour or texture variances may occur.

4.2 Surface Condition and Defects: Our service is solely a custom finishing application and does not include repair. You acknowledge that existing cosmetic damage (such as scratches, dents, chips, pitting, or casting imperfections) on the original item cannot be removed by our process and will be visible beneath the new finish.

4.3 Digital Image and Finish Variation: All sample images, photographs, and renderings provided by us are for illustrative purposes only. The final physical finish will vary from the digital image due to environmental lighting and your screen settings. We do not guarantee a precise match to the image you see.

4.4 Functionality Waiver: Our service is only the application of a finish. We make no guarantees regarding the long-term functionality of your item (e.g., internal valves, flushing mechanisms) before or after the finishing process.

4.5 Guarantee of Workmanship: Our only guarantee is that the custom finishing work itself (the coating application) will be free from defects caused by our process for a period of 12 months from the date of dispatch. This does not cover fair wear and tear, chemical damage, or misuse.

5. Shipping and Risk

5.1 Dispatch and Risk: Once the finished item is signed over to the return courier, the risk of loss or damage transfers back to you. We are not liable for damage or loss incurred during return transit.

5.2 Shipping Costs: Shipping costs to our workshop are the responsibility of yourself, we will ship the item back to you at no cost.

6. Limitation of Liability

6.1 Extent of Liability: Our maximum aggregate liability arising from or in connection with the supply of the service, whether arising in contract, tort (including negligence), or otherwise, shall in all circumstances be limited to the price of the service fee paid by you. We shall not be liable for any indirect, consequential, or special loss.

7. Affiliate Disclosure and Governing Law

BY PAYING FOR AND SUBMITTING YOUR ITEM FOR SERVICES, YOU HEREBY ACCEPT AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING THE STRICT NON-REFUNDABLE AND NO GUARANTEE CLAUSES.
